Is
a Constitutional Convention Possible

An interesting set of events
is occurring in state legislatures that
could have a significant impact on the
future of America. First, thirteen states
have now filed suit relating to passage
of Obama Care. Prior to passage it was
reported that a total of 38 states were
considering law suits. Second, legislation
was submitted to the Florida legislature
calling for Congress to convene a Constitutional
convention (See below) and there is a
lot of talk about a Constitutional amendment
for a balanced Federal budget.
A little research and a
little math and we discover that 38 is
the same number that it takes to pass
an amendment to the Constitution which
we can then couple with Florida's gesture.
It appears at least possible that the
ultimate solution to getting rid of Obama
Care, requiring the Federal Government
to balance its budget and/or other concerns,
may lie in the Constitution. This would
destroy Obama's plan for socializing the
economy. Here are the requirements.
The Constitution allows
the states to call for a Constitutional
Convention with a 2/3 majority of the
states (34). Passage of an amendment by
the convention takes only 50% plus 1 and
approval requires a 75% majority or 38
states. There doesn't appear to be a provision
for review by the Supreme Court, so upon
passage it appears that any amendment(s)
would become law. Obviously, this is pure
conjecture; however, it does suggest a
plausible possibility. A copy of article
V of the Constitution is below.
The Founding Fathers may
have once again saved the Republic from
the intrusions of a government that is
taking away our rights and placing a too
heavy burden on Americans. Between Obama
and the Constitution, Obama may have bitten
off more than he can chew and opened the
door to other amendments such as a balanced
budget amendment.

Calling on Congress to Convene a Balanced
Budget Amendment Convention
On March 1, 2010, President Jeff Atwater
and Speaker Larry Cretul introduced to
the Florida Legislature a resolution calling
on Congress to convene a Balanced Budget
Amendment Convention to require a balanced
federal budget and limit the federal government's
ability to dictate State spending.
Atwater and Cretul are also
filing an advisory referendum to allow
the people of Florida to directly participate
and send a clear, unambiguous message
to Congress about the importance of a
balanced federal budget.
With national debt exceeding
$12.4 trillion and much of that debt owed
to foreign nations, this is a matter of
economic security. Now is the time to
act!

Article V
- Amendment
The Congress, whenever two thirds of both
Houses shall deem it necessary, shall
propose Amendments to this Constitution,
or, on the Application of the Legislatures
of two thirds of the several States, shall
call a Convention for proposing Amendments,
which, in either Case, shall be valid
to all Intents and Purposes, as part of
this Constitution, when ratified by the
Legislatures of three fourths of the several
States, or by Conventions in three fourths
thereof, as the one or the other Mode
of Ratification may be proposed by the
Congress; Provided that no Amendment which
may be made prior to the Year One thousand
eight hundred and eight shall in any Manner
affect the first and fourth Clauses in
the Ninth Section of the first Article;
and that no State, without its Consent,
shall be deprived of its equal Suffrage
in the Senate
